The court delays the demolition of the terrorist's house to hear the family's appeal



The High Court today ordered an interim injunction preventing the army from demolishing part of the family of a Palestinian who was accused of killing two Israelis in a terror attack last month.

A judge gave the state 10 days to respond to a petition submitted by the family of 23-year-old Ashraf Na'albeh not to demolish their home in the village of Shweika in the West Bank. The court said a court hearing would hear the family's petition in the coming days, and a decision would be made before November 22.

A few days after the attack, the IDF issued a demolition order against the home of the latter, in accordance with the policy of house demolitions of convicted Palestinian terrorists.

In most cases, demolition orders are issued after a suspect confesses or is convicted in court. However, in the case of her offense, the IDF decided to take the punishment step because the Shin Bet has significant incriminating evidence against it.

The family first submitted the demolition orders to the IDF, but on Tuesday the appeal was rejected and the army renewed the orders for part of the house.

In a statement published by Major General Nadav Padan, GOC Central Command, it was reported that the basement and ground floors of the house of Na'aluba, in which a suspect lived.

On Wednesday, the families of the victims demanded more severe reprisals by Israel against its insult and family.

At a memorial ceremony held in the Barkan compound, Lavgrund Yechezkel's father, Rafi, said the family demanded that Nalwa be executed if he was caught.

The brother of Fei B criticized the IDF for the decision to demolish only the basement and ground floors of Beit Na'alova.

"The demolition of the house of the terrorist is not acceptable, the entire house must be destroyed," said Haggai, "and the family must be deported."

The demonstrators marched from the entrance to the industrial zone to the Alon Group factory, where Yehezkel and Hagai were killed, and a third Israeli woman, Sarah and Toure, was wounded.

According to the television news "News", the Ministry of Defense is in constant contact with the victims' families regarding the demolition of homes. The station reported that aide to Defense Minister Avigdor Lieberman told Rafi Yehezkel in a telephone conversation that there are legal restrictions, but his boss is working to circumvent them.

After the injunction on Thursday, Rafi Yehezkel attacked the court for "the celebration of the bloodshed of my daughter and the humiliation of our family." The grieving father told reporters that he was ashamed to live "in a country without justice and without compassion," and said he was considering giving up his Israeli citizenship in protest.

IDF soldiers are still searching for the hurt, who has been on the run since killing his colleagues on October 7.

Prime Minister Benjamin Netanyahu on Sunday presented legislation to promote a controversial bill designed to make it easier for Israel to impose death sentences on Israeli civilians and convicted Palestinian soldiers.

Netanyahu approved the legislation that contradicts the advice of the security establishment. According to the radio, Netanyahu told members of his coalition that opposition to the bill by the Shin Bet and the IDF should not prevent them from advancing the legislation.
